Who should receive gifts from vendors in a small business?
Q. I work for a small manufacturing company. The woman who greets customers keeps most of the gifts for herself given by the vendors during the holiday season. One agency gave a thank you for your business gift of a $50 gift card. She kept it. On top of that, she is a Jehovah's Witness. Is there any business etiquette on receiving gifts?

A. Such gifts should be refused and no one should get them and certainly the person you mentioned should not be claiming them all. They should be given to the owner of the company or at least to the manager on duty.

What is the polite way to stop giving Christmas Gifts?
Q. For years now we have been spending lots of time and money on Christmas gifts for my nephews and cousins. On early Christmas not one of them says thank you. So this year with ten days to Christmas neither my wife or I have spent a dime on a gift for anyone. On the big day how should we tell the relatives we did not buy them any gifts at all? And can we morally accept any gifts from them if we don't buy them gifts?

A. A gift is a gift, not a swap, so you can morally accept a gift without giving one. You could just say, before the gift giving, that you have had to cut back in this economy.

What are the reporting requirements on non-resident alien gifts?
Q. My aunt (who meets the IRS definition of being a non-resident alien) intends to give $50k towards my son's college education. My aunt lives in Switzerland. To ensure that the gift is given and received outside of the US (so as to make it non-taxable) I plan to open an account at a foreign bank into which I will receive the gift, and then wire to funds to the university. Gifts from non-resident aliens over $10k normally requires that the recipient file of IRS form 3250. My Question: since this gift is being used for tuition, is it exempt from filing form 3250? IRC 6039F(b) (Notice of Large Gifts Received from Foreign Persons) has exepmtion language for tuition and medical expenses, but I find the language a bit vague. Does someone know if,… [cont.]

A. I'm suspicious of the qualifications of the above "tax consultant" poster. I found the answer in the Form 3250 instructions on the IRS website, linked below, and it does NOT agree with what he states. I certainly won't be paying HIM for any advice any time soon! You don't need to file the 3250 for a couple of reasons. One being the nature of the gift for tuition. The other is that the gift is coming from a foreign person where the reporting limit -- at least as I'm reading it -- is $100,000, not $12,760 (2006 rate, it's adjusted for the cost of living.) Even if the gift had to be reported, it still would not be taxed. The 3250 filing simply advises the IRS of the transfer so that they can evaluate the taxable status of the… [cont.]

When receiving Christmas gifts from other local businesses, what is the correct way to thank them?
Q. I am a receptionist at a local newspaper, and for the past couple of weeks people from businesses and universities have been bringing in Christmas gifts for our office, (a box of oranges, a plate of holiday cookies, etc.) and I was just wondering what we could do to thank them for such a kind gesture. In some cases, the universities are 20 miles (or more) away and I personally feel like it is such a kind thought to bring gifts and treats to us. What can I do to show them that we are truly appreciative?

Q. I have two children my oldest is six and for the past six years I have gone a little overboard with the gifts from Santa, around twenty or thirty gifts per child ranging in cost. I am not wealthy and my children are not spoiled, I simply enjoy the idea of giving, to everyone. This year I am trying to be a little more conservative due to less funds, any tips would be great. What kind of gifts do you take to a civil wedding ceremony?
Q. My cousin is having a civil wedding ceremony tomorrow. I'm just not sure what kind of gift to take. I know that they're planning to have a church wedding in the future, so I was only wondering if we take gifts to both weddings? Besides a gift card, what else can I get them. BTW, I don' think they'll be living together until after the church wedding.

A. I would give them a smaller gift for each wedding. Even if they are not living together after the first wedding, I'm sure they'll be planning their new home together. If they don't have much money, I would go with something practical like towels. We received a bottle of champagne and two champagne glasses, which we loved.

When she gets home from the hospital, depending on the time you could either buy or make her and her hubby a meal (supper?), That's nice too, not having to worry about making dinner at a time like that... and still being able to eat a good healthy meal. Maybe some comfortable outfits that she won't feel slummy in. What are good small gifts to give female friends that would seem unique to Australia or cannot get in the US?
Q. I want to take back small gifts for some of my girlfriends at home, but not sure what. I want it to be cute and something they can't really get in the US or at least if they can, maybe a brand that's only Australia. Of course going to be bringing back some Tim Tams and stuff, but would like to get a nice small gift as well. Any ideas?

A. Tim Tams are a good idea, but what about a small jar of Vegemite? It's quite iconic. Consider buying something small like a t-shirt or bracelet from a surf shop like Rip Curl.

How many gifts should you get for your 3yr old child for christmas?
Q. My son is 3yrs old and I want him to have a good christmas I always did as a child! But I don't want to go overboard with gifts!! So my question is this how many gifts should I buy for him without going overboard?

A. Instead of focusing on the number of gifts focus on how much you want to spend and don't go over that. You can spend over $200 and only by 1 gift or you can spend $200 and have 30+ gifts.

What kind of gifts should i get for a friend?
Q. I didnt get to see them over the winter break, but we just met a few days ago and I recieved a calendar and a set of stamps for my gift.. It's not the greatest gift, but we never agreed on getting anyone gifts so it was a surprise. I want to get something for her in return but when I buy gifts I kind of go all out.. Would it be too much if I got her a lomo fisheye camera for 30$?

A gift or a present is the transfer of something without the expectation of receiving something in return. Although gift-giving might involve an expectation of reciprocity, a gift is meant to be free. In many human societies, the act of mutually exchanging money, goods, etc. may contribute to social cohesion. Economists have elaborated the economics of gift-giving into the notion of a gift economy. By extension the term gift can refer to anything that makes the other happier or less sad, especially as a favor, including forgiveness and kindness.
